Terms of Use

1. Purpose

These Terms of Use govern access to and use of the Buddiz application, a platform that allows users to organize and join sports sessions (padel, tennis, etc.) between individuals.

2. Acceptance

Using Buddiz implies full acceptance of these Terms of Use. If you do not accept these terms, please do not use the application.

6. Direct messaging and contact preferences

By default, any member can send a direct message to another member. Each member can restrict, from their privacy settings or from messaging, who can start a new conversation with them: everyone, only their connections (people they follow, people they have taken part in a sports session with, or people they share a club with), or no one.

Each member can also choose to receive new conversations only from members of a given gender (women or men); only members who have declared that gender can then message them first. This setting is a contact preference, offered identically to all members regardless of their own gender. It also applies to member suggestions.

These preferences apply neither to conversations already open, which remain accessible, nor to people the member chose to follow. A member who cannot start a conversation is informed of it, without the setting involved being disclosed.

To prevent unsolicited messaging, Buddiz limits the number of new conversations a member can start without a reply over a given period, and an adult member cannot message a minor member first. To combat fake accounts, a member must also have certified their profile to message first a member with whom they have no link: certification is not required towards a person who follows them, nor to message the organizer of a sports activity they have joined. These preferences and limits complement, and do not replace, the blocking and reporting provided for in sections 7 and 8.

Any user can block another member from their profile. Blocking prevents any new direct conversation between the two parties. Blocking is reversible at any time from the same profile. The blocked user is not notified of the block.

8. Reporting and moderation

Any user can report a member whose behavior seems inappropriate. Available reporting reasons are:

Each report is sent to the Buddiz team and reviewed promptly. Possible outcomes include a warning, temporary suspension, or permanent deletion of the account, at the publisher's discretion. A user who reports another member in bad faith or abusively may also face consequences.

Reports are limited to 10 per user per 24-hour period.

9. Reliability system

Buddiz includes a reliability score system based on actual session participation. Late cancellations and unreported absences can negatively impact this score. This system aims to encourage respectful and reliable behavior within the community.

10. Liability

Buddiz is a tool for connecting athletes. The publisher cannot be held responsible for events occurring during sports sessions organized via the application. Each user participates at their own risk and is encouraged to take out insurance appropriate for their sport.

11. Intellectual property

All elements of the application (design, code, text, logos) are protected by intellectual property law and belong to Valentin HARRANG. Any unauthorized reproduction is prohibited.

"Buddiz", its logo and its visual identity are protected on that basis: the trademark is filed with the INPI under No. 5248251. Using them requires prior written authorization, in particular in an account name, a domain name, a club name, merchandise, or any communication suggesting a partnership. Any authorization granted (ambassador, club, Spot partner) is personal, revocable, and ends with the role that justified it.

12. User content and image rights

When you publish content on Buddiz, in particular photos added to a session, you remain its owner but you grant the publisher the rights described below.

You grant Buddiz a free, non-exclusive and worldwide licence to host, display, reproduce and adapt this content as part of the operation of the service, as well as for the promotion and communication of Buddiz, including on its social networks and marketing materials. This licence ends when you delete the content, subject to copies already distributed.

You warrant that you have obtained the consent of the identifiable people appearing in the photos you publish, so that they may be displayed within the community and, where applicable, featured by Buddiz. You are solely responsible for the content you publish.

Anyone appearing in a photo may request its removal at any time, via the report function or by writing to the publisher. The photo concerned is removed as soon as possible.

13. Changes to the Terms

The publisher reserves the right to modify these Terms at any time. Users will be informed of substantial changes and asked to accept the new terms to continue using the application.

14. Termination

The user can delete their account at any time from the application settings. The publisher reserves the right to suspend or delete an account in case of violation of these Terms - particularly in case of abusive behavior, circumvention of messaging restrictions, or confirmed repeated reports - without notice or compensation.

15. Applicable law

These Terms are governed by French law. In case of dispute, the parties agree to seek an amicable solution before any legal action. Failing that, the competent courts shall be those of the publisher's registered office.
